Article 1 – About ILBAY’S

1.1 Company details

These Terms and Conditions apply to purchases from:

In these Terms and Conditions, Ilbay’s B.V. is referred to as “ILBAY’S”, “we”, “us”, or “the Store”.

1.2 Definitions

The following definitions apply:

  • Consumer: a natural person acting for purposes outside their trade, business, craft, or profession.

  • Customer: any person or legal entity that enters into an agreement with ILBAY’S.

  • Agreement: the purchase agreement between the Customer and ILBAY’S.

  • Product: any physical product offered by ILBAY’S.

  • Right of withdrawal: a Consumer’s statutory right to cancel a distance contract within the applicable cooling-off period.

  • Website: the ILBAY’S online store and any associated country or language version.

Article 2 – Applicability

2.1

These Terms and Conditions apply to every offer made by ILBAY’S and every Agreement concluded through the Website.

2.2

Before an order is placed, these Terms and Conditions are made available electronically in a form that allows the Customer to save or print them.

2.3

Any terms used by a Customer or business purchaser do not apply unless ILBAY’S has expressly accepted them in writing.

2.4

If an individual provision of these Terms and Conditions is invalid or unenforceable, the remaining provisions remain in effect. The invalid provision will be replaced by a valid provision that reflects its original purpose as closely as reasonably possible.

2.5

If an individual Agreement expressly differs from these Terms and Conditions, the terms of that individual Agreement take precedence.

Article 3 – Products and Offers

3.1

We aim to describe our Products, prices, dimensions, colours, materials, quantities, and other relevant characteristics as accurately as reasonably possible.

3.2

Product photographs and videos are intended to provide a faithful representation. Minor differences may occur because of screen settings, lighting, manufacturing variations, packaging updates, or other reasonable circumstances.

3.3

An offer is subject to availability. Unless a different period is stated, an offer remains valid while it is displayed on the Website and stock is available.

3.4

ILBAY’S is not bound by an obvious error, typographical mistake, technical error, or pricing error that the Customer knew or should reasonably have understood to be incorrect.

3.5

Promotional offers, discount codes, and gifts are subject to the conditions stated with the relevant promotion. Unless expressly stated otherwise, promotions cannot be combined.

Article 4 – Orders and Formation of the Agreement

4.1

The Customer places an order by completing the checkout process and confirming the obligation to pay.

4.2

After receiving an order, ILBAY’S sends an electronic order confirmation. The Agreement is concluded when the order has been accepted by ILBAY’S.

4.3

ILBAY’S may refuse or cancel an order where reasonably necessary, including when:

  • A Product is unavailable;

  • Payment cannot be authorised;

  • The provided information is incomplete or demonstrably incorrect;

  • There is a clear pricing or technical error;

  • There is a reasonable suspicion of fraud, misuse, or unlawful activity;

  • Delivery to the selected destination is unavailable; or

  • The order violates an applicable restriction or promotional condition.

If payment has already been received for a cancelled order, the relevant amount will be refunded.

4.4

The Customer is responsible for providing complete and accurate billing, delivery, and contact information.

Article 5 – Prices and Payment

5.1

Prices displayed to Consumers include VAT and other mandatory taxes unless expressly stated otherwise.

5.2

Shipping charges and any other applicable costs are displayed before the Customer completes the order.

5.3

For deliveries outside the territory covered by the checkout price, customs duties, import taxes, handling costs, or local charges may apply. Unless expressly stated otherwise, these charges are the responsibility of the recipient.

5.4

Payment must be made using one of the payment methods offered during checkout. Additional conditions imposed by a payment provider may also apply.

5.5

Where ILBAY’S offers deferred or instalment payments through a third-party payment provider, the Customer may be subject to that provider’s eligibility assessment and separate terms.

5.6

Prices may change at any time, but a price change will not affect an Agreement that has already been concluded, except where correction of an obvious error is legally permitted.

5.7

If a Customer fails to pay an amount when due, ILBAY’S may exercise the rights available under applicable law. A Consumer will first receive a payment reminder and a legally required additional period in which to pay before statutory interest or collection costs are charged.

Article 6 – Delivery

6.1

Orders are delivered to the address provided by the Customer during checkout.

6.2

Delivery areas, shipping rates, expected delivery times, and applicable free-shipping thresholds are displayed on the Website or during checkout.

6.3

Unless a different delivery period has been agreed, ILBAY’S will deliver an accepted order without undue delay and no later than 30 days after conclusion of the Agreement.

6.4

Delivery estimates are indicative unless ILBAY’S has expressly agreed that a particular delivery date is essential.

6.5

If delivery is delayed, the Customer should allow ILBAY’S a reasonable additional period to complete delivery, unless applicable law permits immediate cancellation.

6.6

The risk of loss or damage remains with ILBAY’S until the Consumer, or a third party appointed by the Consumer other than the carrier, has physically received the Products.

This does not apply where the Consumer independently commissions a carrier that was not offered by ILBAY’S.

6.7

ILBAY’S may use third-party carriers and fulfilment providers to process and deliver orders.

6.8

The Customer must check the shipping address before placing the order. If an incorrect or incomplete address causes additional costs, ILBAY’S may charge those reasonable costs where permitted by law.

Article 7 – Conformity and Statutory Guarantee

7.1

Products must conform to the Agreement and possess the characteristics that the Customer may reasonably expect based on the Product description and applicable law.

7.2

Consumers retain all statutory guarantee rights. Any additional commercial guarantee offered by ILBAY’S or a manufacturer does not replace, reduce, or restrict those statutory rights.

7.3

If a Product is defective, damaged, incomplete, or materially different from what was ordered, the Customer should contact ILBAY’S as soon as reasonably possible and provide:

  • The order number;

  • A description of the issue; and

  • Photographs or other relevant evidence, where reasonably required.

7.4

Depending on the circumstances and applicable law, a Consumer may be entitled to repair, replacement, a price reduction, or termination of the Agreement and a refund.

7.5

Remedies for defective Products will be provided without charge where required by applicable consumer law.

Article 8 – Right of Withdrawal

8.1 Withdrawal period

A Consumer purchasing online has the right to withdraw from the Agreement without providing a reason within 14 days.

For Products, the withdrawal period begins on the day after the Consumer—or a third party appointed by the Consumer other than the carrier—receives the Product.

If Products from one order are delivered separately, the withdrawal period begins on the day after the final Product or shipment is received.

8.2 Exercising the right of withdrawal

To exercise the right of withdrawal, the Consumer must inform ILBAY’S before the withdrawal period expires through an unequivocal statement.

The Consumer may also exercise the right of withdrawal by emailing info@ilbays.com or by using the model withdrawal form included at the end of these Terms and Conditions.

Using the returns portal or model form is recommended but is not mandatory for a valid statutory withdrawal.

8.3 Returning the Products

After notifying ILBAY’S of the withdrawal, the Consumer must return the Products within a further 14 days.

Unless the return instructions provide a different authorised destination, the return address is:

The Consumer should include the order number or return document with the parcel and retain proof of shipment.

8.4 Return costs

The direct costs of returning Products are the Consumer’s responsibility unless:

  • ILBAY’S has agreed to cover those costs;

  • The Product is defective, damaged, incorrect, or otherwise non-conforming; or

  • Applicable law requires ILBAY’S to cover the costs.

For parcels returned from the Netherlands, return costs are approximately €7.25 per parcel. The exact amount depends on the carrier and service selected.

8.5 Handling and diminished value

During the withdrawal period, the Consumer may inspect and handle a Product only as they would reasonably be permitted to do in a physical store.

The Consumer may be responsible for any reduction in value caused by handling beyond what is necessary to determine the Product’s nature, characteristics, and functioning.

Products should, where reasonably possible, be returned complete, securely packaged, and with all supplied accessories.

The absence of the original packaging does not automatically remove the right of withdrawal, but damage or loss of value caused by insufficient packaging may be taken into account.

8.6 Refunds

Following a valid withdrawal, ILBAY’S will refund all payments received for the withdrawn Agreement, including the cost of standard outbound delivery.

If the Consumer selected a delivery method that was more expensive than the least expensive standard delivery option offered, the additional delivery costs will not be refunded.

Where only part of an order is returned, the original shipping costs are not refunded unless required by applicable law.

The refund will be issued within 14 days after ILBAY’S receives the withdrawal notification. ILBAY’S may withhold the refund until the returned Products have been received or until the Consumer provides evidence that the Products have been sent back, whichever occurs first.

The refund will be made using the original payment method unless expressly agreed otherwise. No refund-processing fee will be charged.

8.7 Risk and evidence

The Consumer is responsible for demonstrating that the withdrawal was exercised and the return was sent within the applicable periods. Keeping the return receipt or tracking information is therefore recommended.

Article 9 – Exceptions to the Right of Withdrawal

9.1

Business Customers do not have a statutory right of withdrawal unless ILBAY’S expressly agrees otherwise.

9.2

Where permitted by law and clearly disclosed before purchase, the right of withdrawal may not apply to Products including:

  • Products made according to the Customer’s specifications or clearly personalised;

  • Products that deteriorate or expire rapidly;

  • Sealed Products that are unsuitable for return for health-protection or hygiene reasons where the seal has been broken after delivery;

  • Products that, after delivery, have become inseparably mixed with other items; and

  • Other Products or Agreements expressly excluded from the statutory right of withdrawal.

9.3

An exception applies only where all applicable legal requirements have been met. Opening ordinary shipping packaging does not by itself remove the right of withdrawal.

Article 10 – Complaints

10.1

Complaints can be submitted through the contact page on the Website or by email to info@ilbays.com.

10.2

The Customer should describe the complaint clearly and include the order number and relevant supporting information.

10.3

A Consumer should report a discovered issue as soon as reasonably possible. A notification made within two months after discovering a lack of conformity is considered timely under Dutch consumer law.

10.4

ILBAY’S aims to acknowledge complaints promptly and provide a substantive response within 14 days of receipt.

If additional investigation is required, ILBAY’S will provide an acknowledgement within that period and indicate when a more detailed response can be expected.

10.5

Customers must first give ILBAY’S a reasonable opportunity to investigate the complaint and propose a suitable solution.

10.6 WebwinkelKeur

If ILBAY’S has an active WebwinkelKeur membership and the complaint cannot be resolved directly, the Consumer may request mediation through WebwinkelKeur:

WebwinkelKeur’s current membership directory can be used to verify ILBAY’S membership.

If mediation does not resolve the complaint, the Consumer may be able to submit the dispute to an independent dispute committee designated by WebwinkelKeur. Fees or procedural conditions may apply.

10.7

Consumers residing outside the Netherlands may also seek information from the European Consumer Centre in their country or another competent alternative dispute resolution body.

Article 11 – Intellectual Property

11.1

All intellectual property rights relating to the Website and its content—including trademarks, trade names, photographs, text, graphics, videos, designs, and other materials—belong to ILBAY’S or its licensors.

11.2

Customers may not reproduce, publish, distribute, commercially exploit, or make Website content available to third parties without prior written permission, except where permitted by mandatory law.

11.3

Nothing in these Terms and Conditions transfers any intellectual property right to the Customer.

Article 12 – Privacy and Personal Data

12.1

ILBAY’S processes personal data in accordance with applicable data-protection law, including the General Data Protection Regulation.

12.2

Information about the personal data we collect, the purposes for which it is used, retention periods, service providers, cookies, and data-subject rights is provided in the ILBAY’S Privacy Policy.

12.3

ILBAY’S may share personal data with payment providers, carriers, fulfilment partners, technical service providers, and other parties where this is necessary to process an order or comply with legal obligations.

Article 13 – Events Outside Our Reasonable Control

13.1

ILBAY’S is not responsible for a delay or failure caused by an event outside its reasonable control, provided that this does not restrict any mandatory Consumer rights.

Such events may include severe weather, transport disruption, fire, flood, epidemic, war, civil disturbance, government action, labour disputes, major technical failures, or interruption of essential services.

13.2

If such an event occurs, ILBAY’S will take reasonable steps to limit the consequences and inform affected Customers where appropriate.

13.3

If performance becomes permanently impossible, or a delay gives the Consumer a statutory right to terminate the Agreement, amounts owed following termination will be refunded.

Article 14 – Liability

14.1

Nothing in these Terms and Conditions excludes or limits liability where doing so would be unlawful, including liability arising from mandatory consumer-protection law.

14.2

The Customer must use and maintain Products in accordance with their instructions, warnings, intended purpose, and reasonable safety precautions.

14.3

ILBAY’S is not responsible for damage resulting solely from misuse, improper maintenance, unauthorised modification, normal wear and tear, or failure to follow clear Product instructions, except where mandatory law provides otherwise.

14.4

For business Customers, ILBAY’S will not be liable for indirect loss, loss of profit, loss of revenue, loss of data, or business interruption, except in cases of intent, deliberate recklessness, or where liability cannot lawfully be excluded.

Article 15 – Amendments and Severability

15.1

ILBAY’S may update these Terms and Conditions from time to time. The version applicable to an order is the version made available when that order was placed.

15.2

Material changes do not retrospectively alter an existing Agreement unless the Customer expressly agrees or the change is required by law.

15.3

If a provision is found to be invalid or unenforceable, the remaining provisions continue to apply.

Article 16 – Governing Law and Disputes

16.1

These Terms and Conditions and the Agreement are governed by Dutch law.

16.2

A Consumer retains the protection of any mandatory consumer-law provisions applicable in the country where the Consumer habitually resides.

16.3

Disputes may be submitted to a competent court in accordance with applicable jurisdiction rules. Nothing in these Terms and Conditions deprives a Consumer of the right to bring proceedings before a court that is competent under mandatory law.
